A small number of people may be required to be placed under Guardianship in support of their care and treatment plan. The Mental Health Act Code of Practice (1999) describes the purpose of Guardianship as follows " to enable patients to receive care in the community where it cannot be provided without the use of compulsory powers”. It provides an authoritative framework for working with a patient, with a minimum constraint, to achieve as independent a life as possible within the community. Where it is used it must be part of a patient's overall care and treatment plan."
